There are three common situations from which HIPAA violations being identified:

  1. Investigations into a data breach by Office for Civil Rights or State's Attorney G

  2. Investigations into complaints about the organization
  3. HIPAA or other data security compliance audits

After being notified by a risk assessment or other means, an organization may be willfully negligent of imposing controls on loose media at the organizations.
